The Ministry of Energy and Mines (MINEM) published on March 26 a draft Supreme Decree that sets out the regulations for Law No. 32190, which establishes a unified registry for people affected by oil spills or leaks. The ministry said the document is now open for public comment from citizens and interested parties.
This initiative aims to improve how individuals impacted by hydrocarbon spills are identified and to ensure fair and transparent compensation from responsible companies. The proposal was developed in coordination with the Presidency of the Council of Ministers, Ministry of Health, Ministry of Environment, and MINEM, reflecting an effort to address environmental emergencies related to hydrocarbons in a coordinated manner.
According to MINEM, the proposed regulation details protocols for registering affected persons in a consolidated list. During this registration process, several agencies will participate: the Environmental Assessment and Enforcement Agency (OEFA), local governments, National Institute of Civil Defense (INDECI), and the Ministry of Health will all play roles in oversight or support.
MINEM’s Office of Social Management will oversee publication of affected persons’ lists as well as monitor agreed compensations between companies and those registered. This falls within its role to promote constructive relationships between energy sector companies and communities.
